1. Acceptance of Terms

By accessing or using the AavionD website (aaviond.com) or any services provided by AavionD LLC ("AavionD," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms apply to all visitors, users, clients, and any other persons who access or use our website and services.

2. Description of Services

AavionD LLC provides Independent Facilitator services for individuals and families participating in California's Self-Determination Program (SDP). Our services include but are not limited to:

• Person-Centered Plan (PCP) development and facilitation
• Guidance through the SDP enrollment and transition process
• Support with Regional Center coordination and IPP meetings
• Budget certification review and spending plan development
• Financial Management Service (FMS) selection guidance
• Secure online forms for intake, documentation, and communication

3. Information Submitted Through Forms

We collect information through online forms on our website, including intake forms, contact forms, and questionnaires. When submitting information through our forms, you agree to:

• Provide accurate and complete information
• Only submit information that you are authorized to share
• Notify us if any submitted information needs to be corrected or updated

Information submitted through our forms is stored securely and used solely for the purposes described in these Terms and our Privacy Policy.

4. User Responsibilities

When using our website and services, you agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Provide false, misleading, or inaccurate information
• Attempt to gain unauthorized access to any part of our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our website or services
• Upload files that contain viruses, malware, or other harmful content

5. Fees & Payment

Fees for Independent Facilitator services are determined on a per-client basis and will be communicated to you before services begin. Payment terms, schedules, and accepted methods will be outlined in your service agreement.

In many cases, Independent Facilitator services under the Self-Determination Program may be funded through the participant's individual budget as authorized by the Regional Center. AavionD will work with you and your Financial Management Service (FMS) to ensure proper billing and documentation.

Definition of Deliverables

"Deliverables" refer specifically to the completed Person-Centered Plan (PCP), the finalized Spending Plan, or documented research lists (provider contacts) for which the Independent Facilitator has been specifically engaged and billed.

Transfer of Ownership

Upon receipt of final payment, the Independent Facilitator will hand over all completed Deliverables and relevant SDP documents to the Participant.

6. Intellectual Property

All content on the AavionD website, including text, graphics, logos, icons, images, and software, is the property of AavionD LLC or its content suppliers and is protected by United States and international copyright laws.

Person-Centered Plans and other documents created collaboratively during the facilitation process belong to the individual and their family. AavionD retains copies for record-keeping purposes as required for service delivery.

7. Limitation of Liability

To the fullest extent permitted by applicable law, AavionD LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of our website or services.

AavionD does not guarantee specific outcomes from Regional Center processes, budget certifications, or SDP enrollment. Results depend on individual circumstances and decisions made by Regional Centers and other agencies.

8. Indemnification

You agree to indemnify, defend, and hold harmless AavionD LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

Either party may terminate the service relationship at any time with written notice. Upon termination:

• All pending form submissions and active services will be concluded
• You may request copies of your documents and records
• Any outstanding fees remain payable
• We will assist with transition to another facilitator if applicable

Payment at Termination

In the event of termination by either party, the Independent Facilitator shall be compensated for all hours worked up to the termination date. If the SDP transition is incomplete, the Independent Facilitator will provide the "work-in-progress" files (drafts, contact logs, research) corresponding to the hours billed.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of California.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page. We will update the "Last updated" date at the top of this page to reflect any changes. Your continued use of our website or services after any modifications constitutes acceptance of the updated Terms.
